Montenegro - Technical assistance to the Ministry of Transport, Maritime Affairs and Telecommunications of Montenegro for transposition of RTT&EMC Directive

Two (2) senior experts qualified to carry out tasks from the terms of reference of this framework contract with the total budget of 40 working days. At least 90% of the overall working day allocation is to be delivered in Montenegro, while the balance may be delivered at the consultant’s/experts’ usual place of residence against a work programme to be approved in writing by the Contracting Authority. The Senior Expert I will be engaged for a total of 25 working days over a maximum of three missions whereas the Senior Expert II will be engaged for a total of 15 working days over a maximum of two missions. Both experts should have good communication and writing skills.


Profile required (education, experience, references and category as appropriate)

The experts should demonstrate through their CVs the following knowledge and professional characteristics:

Senior Expert I, 25 working days

Qualifications and skills:

• Education at least up to University degree (where a university degree has been awarded on completion of four years study in a university or equivalent institution) in a field relevant to this assignment (e.g. electronic communications, law or similar)

General professional experience
• At least 10 years of professional experience in the electronic communications field preferably working in an EU Member State institution (ministry or regulatory agency with active involvement in EC bodies like TCAM and ADCO) in charge of the supervision of compliance with relevant EU Directives or in a Notified Body operating under certain relevant Directives (e.g. LVD, RTT&EMC Directives)

Specific professional experience
• Experience in drafting of legislation and/or consulting related to it in EU Member Sate or in countries which were or are candidates and/or potential candidate countries for joining the EU (experience in SEE countries would be an asset).
• Experience in dealing with issues encompassed by the RTT & EMC Directive. Active participation in international bodies (e.g. WTO, ITU, CEPT) competent for such issues would be an asset.

Language skills
• Fluency in English language, both written and spoken.

Senior Expert II, 15 working days

Qualifications and skills:

• Education at least up to University degree (where a university degree has been awarded on completion of four years study in a university or equivalent institution) in a field relevant to this assignment (e.g. electronic communications, law or similar)

General professional experience
• At least 10 years of professional experience in inspection services in the electronic communications field preferably working in EU Member State institution (ministry or regulatory agency with active involvement in EC bodies like TCAM and ADCO) in charge of supervision of compliance with relevant EU Directives

Specific professional experience
• Experience in knowledge transfer and training of employees of supervisory and/or regulatory bodies in EU Member Sate or in countries which were or are candidates and/or potential candidate countries for joining the EU (experience in SEE countries would be an asset)
• Experience in designing and implementing training of inspection services in the field of electronic communications

Language skills
• Fluency in English language, both written and spoken. Knowledge of one of local languages (Serbian, Croatian, Montenegrin or Bosnian) would be an asset.

The beneficiary of the Project is the Ministry of Transport, Maritime Affairs and Telecommunications of Montenegro

Global objective

The global objective is to create legal framework in accordance with EU Acquis for placing on the market, free movement and putting into service RTTE equipment and electrical and electronic equipment which could impact electromagnetic interference in Montenegro.

Specific objective(s)

The specific objective is to provide draft of the Law and regulations for creation of the above mentioned legal framework with provision of training for the inspection service that will have a special obligation to implement the above laws and regulations.

Requested services, including suggested methodology

The Contractor will provide following services to the beneficiary over a maximum period of 6 months:

1) Technical assistance to the beneficiary in the process of composing of the draft Law and regulations.

2) Support to beneficiary in preparation of public debates and preparatory work and guidelines for further alignment of local legislation with EU Acquis as pertinent Directives change in the future.

3) Training on legal framework (including its implementation) of 4 inspectors

Proposed methodology:

Experts engaged by the Contractor will perform following activities:
• Analysis of the current situation in Montenegro regarding the current legislation;
• Preparation of a working version (draft) of the Law for radio equipment, telecommunications terminal equipment and electromagnetic compatibility;
• Support to the beneficiary during the public debate;
• Development of working versions of the guidelines-recommended for making and use supporting documents of the RTT &EMC;
• Provision of specialized training in the field of inspection.

Required outputs

The outputs of the assignment will be, as follows:
• Draft Law
• Draft Guidelines
• Analysis of the proposed measures in the EU member state on its market
