The team of experts as foreseen by these ToR will comprise one (1) person, Category I, on site.
International Monitoring and Evaluation Expert: CAT I
Qualifications and skills:
• A University Degree in law, political science, social sciences, or in a field directly related to these ToR;
• At least 5 years proven professional experience in the field of monitoring and evaluation in developing countries;
• Proven professional experience in updating and/or reviewing national development strategies. Previous experience in establishing and/or reviewing a Justice Sector strategy will be a strong asset;
• Demonstrated professional experience in establishing and/or operating M&E systems of national strategies;
• Proven previous experience with similar projects, especially in conflict and post-conflict countries, will be an asset;
• Strong analytical skills;
• Excellent command of the English Language, both orally and written;
• Knowledge of Dari will be an asset;
• Capacity to adapt to hard working conditions.
4. LOCATION AND DURATION
• Expected start date : 12th September 2010
• Foreseen finishing period: 12th January 2011
• Total duration of assignment: 360 days
• Location(s) of assignment: The field phase will be carried out in Afghanistan, particularly in Kabul. Missions to other parts of the country might be possible, depending on transport and other resource capabilities.
• Office space: The consultant shall work in the offices provided by the PSU and the Justice Institutions.
These terms of reference relate to the update of the National Justice Sector Strategy (NJSS) and National Justice Project (NJP) of the Government of Afghanistan and the establishment of a Monitoring and Evaluation (M&E) framework.
2.1 Global objective
The objective of this project is to support the GoA, in particular the Justice Institutions, to assess progress on the implementation of the NJSS and NJP and establish a prioritization of key objectives.
2.2 Specific objective
This review process will provide the Justice Institutions, and all other relevant actors in the international community with sufficient information to:
a. make an overall independent assessment about the implementation stage of the NJP and performance of the programme, paying particularly attention to the impact of the programme actions against its objectives;
b. identify necessary changes to the NJP objectives and performance indicators, including changes to the logical framework
c. develop an appropriate Monitoring&Evaluation framework and propose an institutional structure for this M&E framework
d. identify key lessons and to propose corrective actions, if needed
It has to be noted that the overall benchmarks in the Rule of Law area as established in the London Compact might be reviewed in the forthcoming Kabul Conference which is expected to take place in July 2010. This has to be taken into account when performing the requested services.
2.3 Requested services
The expert shall work closely with the PSU and the WB and report to the Justice Institutions and to the EU Delegation. If necessary, the consultant will work together with the ANDS team of the Ministry of Finance (MoF).
For the project as described above the Government of Afghanistan (through the EU Delegation) require the following services, without being limited to:
• Review and assess the progress of the NJP i.e achievements and present status of the implementation of the programme with clear indications on the extent to which objectives/outputs are being achieved. This should be done based on the frameworks and formats agreed with the Justice Institutions (and possibly also donors).
• Collect, compile all the information from relevant sources (the Justice Institutions, international donors and other stakeholders) and relate the findings to coherent and realistic conclusions and recommendations. This should include a collection and analysis of lessons learned.
• Based on the above, update the NJP and NJSS paying particular attention to the review of the goals/objectives, outcomes, outputs and inputs, performance indicators and logical framework. Particular attention should be paid to the sequencing of reforms.
• Assist the Justice Institutions and its partners in the formulation and development of M&E system for the NJP.
• Prepare a monitoring and evaluation plan for each of the Justice Institutions which will provide detailed definitions of benchmarks, objectives, performance indicators, the data source, the method of collection, the baseline and target value and how such information should be used.
• Support the Justice Institutions and the PSU in the organization of seminars and workshops to initiate a consultative (and inclusive) process to review implementation of the NJP and ways forward. Participants to these seminars and workshops can include relevant stakeholders, think-tanks, NGOs, consumer and business associations, etc.
• Build capacity, by way of on-the job training, both for the PSU staff and personnel in the Justice Institutions in relation to monitoring and evaluation activities.
2.4 Required outputs
The expert will deliver, without being limited to:
• An update of the NJSS and the NJP, addressing progress towards implementation
• A revised NJP logframe
• The establishment of a Monitoring and Evaluation Framework, including its institutional structure
• The establishment of Monitoring and Evaluation plans for each of the Justice Institutions
• The holding of a series of workshops and seminars
• Any other output in relation to these services that might be requested by the POC
